1. Introduction

Welcome to Bundle Kraft. These Terms of Service (“Terms”) govern your access to and use of Bundle Kraft’s website, products, services, software, and related documentation (collectively, the “Services”). By registering for, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

Bundle Kraft is provided by Bundle Kraft (the “Company”). If you are accepting these Terms on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.

By creating an Account or using the Services, you accept these Terms. Bundle Kraft may modify the Terms from time to time. We will post changes on the website and indicate the "Last updated" date. If you continue to use the Services after we post changes, you accept the updated Terms. If you do not agree to the changes, you must stop using the Services.

4. Account Registration, Users & Security

To use certain features you must register and create an Account. You agree to provide accurate and complete information and keep it current.
Each Account may create Users and assign roles/authorizations. You are responsible for all activity under your Account and for maintaining the confidentiality of login credentials.
Notify us immediately of any unauthorized use.
You must be at least 18 years old or have legal authority to use the Services.

5. Plans, Fees & Billing

Bundle Kraft offers a Free Plan and Paid Plans (Growth, Unlimited). Plan details and pricing are displayed on the website and in the app.

Free Plan: includes core features and allows up to 5 active bundles. Priority support is provided to all users, including Free Plan users.

Paid Plans: Growth Plan ($14.99/month) and Unlimited Plan ($34.99/month) include additional features, unlimited bundles, and other enhancements.

Fees are billed in advance on a monthly or annual basis (as selected). All fees are non-refundable unless otherwise stated in writing. Taxes are the Client’s responsibility.

Upgrades take effect immediately; downgrades may result in reduced features or the removal of bundles exceeding the new plan’s limits. We will apply any prepaid unused portion of your prior plan toward the new plan per our billing policy.

6. Free Trial

If we offer a free trial, the trial period is as specified at sign-up. At the end of the trial, you must select a Paid Plan to continue using Paid Plan features. If you do not pay the required fee, we may suspend or delete the Account and associated Client Data in accordance with these Terms.

7. Use of Services & Restrictions

You may use the Services only in accordance with these Terms and applicable law. You will not (and will not permit others to): reverse engineer the Services, harvest data other than via provided APIs, interfere with the Services or bypass any security protections, or use the Services to infringe third-party rights.
Certain uses may require our prior written consent (for example, reselling the Services).

8. Client Data & Privacy

You retain ownership of Client Data. By uploading Client Data, you grant Bundle Kraft a non-exclusive right to host, copy, transmit, and display the Client Data as necessary to provide the Services and for aggregated/anonymized analytics.

You represent that you have all rights necessary to upload and process Client Data and that Client Data complies with applicable law.

Our Privacy Policy (https://bundlekraft.com/privacy-policy) explains how we collect, use, and share personal information. By using the Services you consent to the data practices described in the Privacy Policy.

9. Data Processing & GDPR

If you are in the EU or processing data of EU residents, these Terms constitute our Data Processing terms to the extent required by applicable law. Bundle Kraft will implement appropriate technical and organizational measures to protect personal data. Upon termination, we will delete or return personal data subject to any statutory retention obligations.

10. Security & Backups

We implement industry-standard administrative, physical, and technical safeguards to protect Client Data. You are responsible for maintaining backups of Client Data you consider necessary. We will not be liable for loss of Client Data except as required under applicable law.

11. Support

We provide support via in-app channels and via the contact methods listed in the app or on our website. Priority support is offered to all users, including the Free Plan. Response times depend on plan level and the nature of the issue.

12. Intellectual Property

Bundle Kraft and its licensors retain all rights, title, and interest in and to the Services, software, trademarks, logos, and other Bundle Kraft materials.

You retain ownership of your Client Data. You grant Bundle Kraft a license to use Client Data as necessary to provide the Services (hosting, processing, backup, improvement of services, aggregated analytics).

You may not copy, modify, distribute, or create derivative works of Bundle Kraft’s software or materials except as expressly authorized.

13. Third-Party Integrations and Links

The Services may integrate with third-party platforms (e.g., Shopify) and include links to third-party sites. We are not responsible for third-party services or their content. Use of third-party services may be subject to additional terms.

14. Warranties & Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind unless expressly stated. To the fullest extent permitted by law, Bundle Kraft disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Services will be uninterrupted or error-free or completely secure.

15. Indemnification

You agree to indemnify and hold Bundle Kraft and its affiliates harmless from any claims, losses, damages, liabilities, costs and expenses (including legal fees) arising from your breach of these Terms, your misuse of the Services, your Client Data, or your violation of third-party rights.

16. Limitation of Liability

To the maximum extent permitted by law, Bundle Kraft’s aggregate liability to you for claims arising out of or related to these Terms will not exceed the total fees paid by you to Bundle Kraft in the six (6) months preceding the event giving rise to liability.

In no event shall Bundle Kraft be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages (including lost profits, lost revenue, or lost business opportunity) even if advised of the possibility of such damages. Some jurisdictions do not permit limitation of certain damages; in such cases, liability will be limited to the extent permitted by law.

17. Termination

Either party may terminate these Terms as provided in the app or by written notice. We may suspend or terminate your Account for violation of these Terms or abuse of the Services. Upon termination, you must stop using the Services. We will retain Client Data for a limited period (generally up to six months) to allow export or reactivation, after which we may delete data per our data retention policies. Fees are non-refundable unless required by law.

18. Export & Compliance

You shall comply with all export and import laws and regulations applicable to your use of the Services. You will not use the Services in violation of any export restrictions.

19. Governing Law & Dispute Resolution

These Terms are governed by the laws of the jurisdiction in which Bundle Kraft is incorporated, without regard to conflict of law rules. Any disputes arising out of or in connection with these Terms shall be resolved first through good faith negotiations. If unresolved, disputes may be submitted to the courts competent in Bundle Kraft’s jurisdiction unless otherwise required by applicable law.

20. Changes to the Services

We may change, enhance, or discontinue features of the Services at any time. We will provide notice of material changes as required by law. Continued use after changes constitutes acceptance.

21. Notices

We may provide notices by email to the address associated with your Account or by posting notices in the app. Legal notices shall be sent to the contact information provided in your Account.

22. Miscellaneous

Entire Agreement: These Terms (including the Privacy Policy and any incorporated documents) constitute the entire agreement between you and Bundle Kraft regarding the Services.

Severability: If any provision is held invalid, the remaining provisions will continue in full force and effect.

Assignment: You may not assign these Terms without our prior written consent. Bundle Kraft may assign these Terms to an affiliate or successor.
